model contract

Below you can read the standard contract for smaller grants/projects. We may come up with specific or different conditions.

Model Contract between Document Our History Now and ….. (to be filled in).

(The words ‘producer/documentary maker’ in this contract are also understood to stand for ‘photographer’, ‘journalist’, ‘artist’ or ‘documentalist’, as the case may be. Similarly, the words ‘production/document’ in this contract are also understood to stand for ‘photography’, ‘art work’, ‘article’, ‘(documentary) film’ or any other product made or produced by the applicant.)

General contract statements:

Document Our History Now will finance the agreed-upon budget for a production/document on the basis of the written proposal received (i.e. the Document Our History Now Grant Application Form).

Half of this budget will be transferred to the producer/documentary maker prior to the making of the production/document. The second half of the budget will be paid out only after Document Our History Now has received:

  • a hard copy of the final production/document and the trailer (on a disc or USB stick) or a successful digital transfer (for instance via mail, WeTransfer or Dropbox). A documentary (and the trailer) must meet the Vimeo specifications.
  • biographical / professional information about the producer/documentary maker and a few photos of the production/document for use on the Document Our History Now website.

Document Our History Now will show the production/document on its website after having uploaded it in Vimeo. The producer/documentary maker will cooperate in every way to make this possible.

The producer/documentary maker must notify Document Our History Now about the first version of the production/documentary before the starting on the final stage of production/finishing. Document Our History Now has the right to comment on that first version. Document Our History Now and the producer/documentary maker must come to an agreement about how to handle the comments. If no agreement is reached, Document Our History Now could decide to withdraw from the project, in which case the second payment would not be made.

The producer/documentary maker is free to send the production/document to film/art festivals, film houses, galleries, etc. It is understood that Document Our History Now will only be able to provide limited assistance in that connection. If the producer/documentary maker wants to submit the production to such festivals, etc., he/she will need to produce a trailer which Document Our History Now may show on its website for a year, before uploading the full production/documentary.

Document Our History Now is entitled not to show the production/document on its website if Document Our History Now considers it to be of poor quality or does not agree with its content.

The budget provided can only be used for the project as described in the application form. Any substantial changes in that regard must be communicated to Document Our History Now in advance, and Document Our History Now will need to give its permission for those changes.

The Document Our History Now logo must be clearly shown at the end of the documentaryand it must be made explicit that Document Our History Now is the sponsor (or one of the sponsors) or producer. Also other productions must make clear that it is sponsored by Document Our History Now. Document Our History Now may also insist that the logo(s) of any co-sponsor(s) are shown as well (for instance sponsors of Document Our History Now itself).

If any financial proceeds are generated from this production/document, the producer/documentary maker must report those to Document Our History Now and give Document Our History Now 50% of those proceeds, up to twice the total amount of the sponsored budget. If the proceeds exceed twice the amount of the sponsored budget, the producer/documentary maker can propose ways to use it (preferably for a new production/document and a donation to Document Our History Now). If a next documentary/production can be financed with the proceeds, a next contract for that documentary/document has to be agreed on with Document Our History Now.

The producer/documentary maker has the right to look for other sponsors as well. If the documentary generates financial proceeds, it is understood that any additional sponsors will each benefit pro rata.

If a distributor, film festival, TV station, magazine, Internet/social media site/blog or other publication channel shows an interest in paying for the use of the documentary or production (or a part of it), Document Our History Now must be informed of that.

If the production/document is accepted for viewing, distribution, printing or any other means of public exposure, Document Our History Now must be notified by e-mail to that effect. In this way, Document Our History Now can maintain a track record of the public exposure of the productions/documents it sponsors. The producer/documentary maker must send Document Our History Now an update about the exposure that his or her production/document has received. An overview (in Excel) must be sent in every half a year by the producer/documentary maker to Document Our History Now.

The producer/documentary maker will do everything in his or her power to inform any persons filmed/documented that their face/story will be out in the public domain. The producer/documentary maker will discuss this more than once with the subjects concerned, both before and after the filming, and the subjects must give their explicit permission to that effect, preferable by signing a quit-claim.
